Did you think that yesterday's post ("Class Action Lawsuit Yields Windfall Profits for Lawyers") described a rare occurrence? Think again and then read this post from CJAC, "Plaintiffs' Attorneys to Get $800,000 in Preliminary Settlement, Class Members Receive Zero."
The post briefly describes (with links leading you to further details) the cy pres award -- "a charitable construction that comes from unclaimed funds in class action settlements" which has become the trial lawyers' new tool to push unfair settlements through the courts.
(I came across this item at Overlawyered, a very nifty blog which is "chronicling the high cost of our legal system." Check it out.)
