Out of Denver comes a piece of very bad news for fans of McCain/Feingold but very good news for those who desire the constitutional guarantees of free speech to be accepted by our modern judiciary. Below is the quick A.P. blurb...
A federal appeals court affirms that voter-approved campaign finance restrictions on an anti-abortion group are unconstitutional.
The Colorado Right to Life Committee had challenged Amendment 27. The measure bans corporations from using their general funds to make political contributions or pay for electioneering materials. The 10th U.S. Circuit Court of Appeals agreed that Colorado Right to Life was an exception because it's not a business corporation.
Secretary of State Mike Coffman also had argued that the group had to register as a political committee and was subject to financial disclosure requirements. The court ruled that the group didn't qualify because its major purpose isn't to promote or defeat certain candidates.
