U.S. District Judge Henry Hudson (a George W. Bush appointee) has declared the Obama administration's health care reform law unconstitutional.The ruling was on Virginia Attorney General Ken Cuccinelli's lawsuit challenging ObamaCare's requirement that citizens buy health insurance or pay a penalty starting in 2014. Hudson agreed that the individual mandate provision of the law exceeded Congress' powers under the Commerce Clause of the Constitution.
The stage is being set for a Supreme Court showdown.
